Terms & Conditions

By registering for and participating in any workshop, event, or educational offering (the “Workshop”) hosted by Andrew Kung Group/Andrew Kung Photography (“we,” “us,” or “our”), you agree to the following Terms & Conditions. Please read them carefully before completing your registration and payment.

1. Registration & Payment

All registrations must be completed through our official registration and payment process. Full payment is required at the time of registration to secure your spot in the Workshop unless otherwise stated in writing. All registrations with non-payment will be cancelled and made null and void after 24 hours.

Your registration is not confirmed until payment has been successfully processed.

2. Cancellations, Refunds & Transfers

Because workshops involve limited capacity, preparation, and resource allocation:

  • All sales are final.

  • We do not offer refunds for cancellations, no-shows, or partial attendance.

Transfer Policy

If you are unable to attend, you may request to transfer your registration to another individual by notifying us in writing at least 7 days prior to the Workshop date. Transfers are subject to our approval and may not be permitted for all Workshops.

In the event that we must cancel or reschedule the Workshop, you will be offered the option of:

  • A full refund, or

  • A credit toward a future workshop or event.

3. Workshop Content & Intellectual Property

All materials provided during the Workshop—including but not limited to presentations, slides, videos, documents, exercises, and recordings—are the intellectual property of Andrew Kung Group/Andrew Kung Photography unless otherwise stated.

You may:

  • Use Workshop materials for your personal or internal business use

You may not:

  • Copy, reproduce, distribute, sell, share, or publish Workshop materials

  • Record the Workshop (audio or video) without prior written consent

  • Use Workshop content to create competing products, courses, or workshops

4. Participant Conduct

We aim to foster a professional, respectful, and collaborative environment.

By participating, you agree to:

  • Treat facilitators and fellow participants with respect

  • Refrain from disruptive, inappropriate, or abusive behavior

We reserve the right to remove any participant whose behavior is deemed disruptive or harmful, without refund.

5. Assumption of Risk

Participation in the Workshop is voluntary. You understand that results are not guaranteed and that outcomes may vary based on individual effort, experience, and circumstances.

You assume full responsibility for any decisions or actions taken as a result of information provided during the Workshop.

6. No Professional Advice Disclaimer

The Workshop is provided for educational and informational purposes only and does not constitute legal, financial, medical, or other professional advice.

You should consult appropriate professionals before making decisions based on Workshop content.

7. Limitation of Liability

To the fullest extent permitted by law, Andrew Kung Group/Andrew Kung Photography shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your participation in the Workshop.

In no event shall our total liability exceed the amount paid for the Workshop.

8. Media Release & Model Release

By participating in the Workshop, you grant Andrew Kung Group/Andrew Kung Photography the irrevocable right and permission to photograph, record, and otherwise capture your likeness, voice, image, and participation during the Workshop.

You agree that such media may be used, edited, reproduced, distributed, and published for lawful promotional, marketing, educational, or commercial purposes, including but not limited to websites, social media, advertising, and printed materials, without compensation.

You waive any right to inspect or approve the finished media and release Andrew Kung Group from any claims related to the use of such media.

If you do not wish to be photographed or recorded, you must notify us in writing prior to the Workshop.

9. Privacy

We respect your privacy. Any personal information collected during registration will be used solely for purposes related to the Workshop and will not be sold or shared except as required to process payments or as required by law.

10. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Kentucky and Jefferson County, without regard to its conflict of law principles.

11. Agreement

By completing your registration and submitting payment, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full.
